Terms of Service
These Terms of Service ("Terms") are an agreement between you and Motion Academy LLC, a Colorado limited liability company ("Motion," "we," "us"), and govern your use of Motion Method AI at motionmethodai.com and any related services (the "Service"). By creating an account, starting a trial or using the Service, you agree to these Terms and to our Privacy Policy. If you are using the Service for a business, you agree on behalf of that business.
1. Who can use the Service
You must be at least 18 years old and able to enter a binding contract. You are responsible for the accuracy of the information you give us and for keeping your password secure. You are responsible for everything that happens under your account, including activity by teammates you invite.
2. What the Service is
Motion Method AI is an online software platform that provides AI-assisted marketing and sales tools, coaching, training, a member community and related features. We may add, change or remove features over time. Some features depend on third-party services (for example, AI providers or apps you choose to connect) and may change or stop working if those services change.
3. Memberships, free trials and billing
- Plans. Memberships are offered monthly or annually at the prices shown at checkout. Prices may change; we will tell you before a price change applies to your next renewal.
- Free trial. New members may receive a free trial (currently 10 days), offered once per person. You will be asked for a payment method when the trial starts. Unless you cancel before the trial ends, your membership automatically converts to a paid membership and your payment method is charged the plan price on the day the trial ends.
- Automatic renewal. Paid memberships renew automatically at the end of each billing period (monthly or yearly) at the then-current price until you cancel.
- Cancelling. You can cancel any time from Settings › Billing & usage › Manage billing, or by emailing support@sellwithmotion.com. Cancellation stops future charges; you keep access until the end of the period you already paid for.
- Refunds. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods, unused time or unused credits. If you believe you were charged in error, contact us within 30 days.
- Failed payments. If a renewal payment fails, we may give you a short grace period to update your card, after which access may be paused until payment succeeds.
- Payment processing. Payments are processed by Stripe. We do not store your full card number.
- Taxes. Prices do not include taxes unless stated; you are responsible for any applicable taxes.
4. AI credits
Many features use AI credits. Your membership includes a monthly credit allowance that resets each month and does not roll over. You may also earn bonus credits or buy credit packs; bonus and purchased credits do not expire while your account is active. Credits have no cash value, cannot be transferred or sold, and are not refundable. Different actions use different amounts of credits, and we may adjust how many credits an action uses. If your membership ends, unused credits can no longer be used.
5. Motion Academy students
Motion Academy students may receive access through an invitation from us. Access granted this way is governed by these Terms and any terms of your Motion Academy enrollment.
6. Your content
You keep ownership of the content you put into the Service (for example, your stories, offers, customer details, documents, uploads and recordings) and of the content the Service generates for you, to the extent the law allows. You give us a limited license to host, process, transmit and display your content only as needed to run, secure and improve the Service for you and to provide support. You are responsible for having the rights to everything you upload, including any people's names, voices, images or personal information, and for getting any permissions required.
7. AI-generated output
The Service uses artificial intelligence. AI output can be inaccurate, incomplete, similar to output given to others, or inappropriate for your situation. You are responsible for reviewing and verifying everything before you use or publish it, including making sure your marketing and sales materials are truthful and comply with advertising, consumer-protection, email, privacy and other laws (for example, claims about results, testimonials, pricing, scarcity and deadlines must be true). Output is not legal, financial, tax or other professional advice.
8. No guarantee of results
The training, coaching and examples in the Service are educational. Any results, income or sales numbers we or others share are not typical and are not a promise of what you will achieve. Your results depend on your effort, skills, market and many other factors. We make no guarantee that you will earn any money or make any sales.
9. Acceptable use
You agree not to:
- use the Service to break any law, send spam, or create deceptive, defamatory, harassing, hateful or infringing content;
- impersonate anyone or misrepresent your affiliation with any person or business;
- upload malware or try to access accounts, data or systems you are not allowed to access;
- scrape, copy, resell or reverse engineer the Service, or use it to build a competing product;
- share your login or use automation to get around credit limits or usage limits;
- post content in the community that is abusive, spammy or that you do not have the right to share.
We may remove content or suspend accounts that violate these Terms.
10. Apps you connect
You may connect third-party accounts such as Google (Gmail, Calendar, YouTube), Instagram, Facebook Pages or Stripe. When you do, you authorize us to access the data and take the actions those connections allow, on your behalf, only to provide the features you use. Your use of those services is governed by their own terms. You can disconnect them at any time.
11. Our intellectual property
The Service, including its software, design, training content, frameworks as presented, and branding, belongs to Motion or its licensors and is protected by law. We give you a personal, non-transferable, revocable right to use the Service during your membership under these Terms. Third-party names and trademarks referenced in the Service belong to their owners.
12. Feedback
If you send us ideas or suggestions, we may use them without any obligation to you.
13. Ending your account
You may stop using the Service and cancel at any time. We may suspend or end your access if you violate these Terms, fail to pay, or if we stop offering the Service. When your access ends, you will no longer be able to use the Service; we keep or delete your data as described in our Privacy Policy.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT DATA WILL NEVER BE LOST.
15. Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, MOTION AND ITS OWNERS, EMPLOYEES AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
16. Indemnity
You agree to defend and hold Motion harmless from claims, losses and costs (including reasonable attorneys' fees) arising from your content, your use of the Service, or your violation of these Terms or the law.
17. Governing law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Colorado, and you and we consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve it informally.
18. Changes to these Terms
We may update these Terms. If a change is material, we will let you know (for example, by email or in the app) before it takes effect. Continuing to use the Service after a change takes effect means you accept it.
19. General
These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver. You may not transfer these Terms; we may transfer them as part of a merger, sale or reorganization.
